YARNELL SCHOOL ONLINE Terms and Conditions

These terms and conditions are based on the Yarnell School Online (hereafter YSO) as of this writing and Yarnell Studio & School of Fine Art LLC (hereafter Yarnell). Yarnell reserves the right to make changes to its website (YarnellSchool.com), its policies, and these terms and conditions at any time. If any of these terms or conditions shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining terms and conditions

RESPONSIBILITY

I understand that the YSO is designed to further enhance my ability as an artist whether I am a beginner or an aspiring painter wanting to improve my painting skills. While Yarnell hopes that I will find my inspiration and enhance my skills with YSO, I understand that Yarnell makes NO GUARANTEE of these outcomes. Yarnell does guarantee 24/7 access to the rich selection of online teaching materials created by Master Artist Jerry Yarnell, and his 30 years of teaching experience are at my fingertips. Further, I understand that I should use the YSO ‘sneak peek’ page to made sure that a subscription with YSO will meet my needs.

FEES AND REFUND POLICY

At the time of my online enrollment at the YSO, I am required to pay for the full and total cost and fees of the online subscription. On the registration page I understand that I can select from 2 online subscription options: monthly (no long-term commitment) subscription or bi-annual subscription.

By completing the registration process and subscription option payment, my YSO online subscription is activated and made available for immediate use. This is considered my “activation date”. YSO access will be granted for the duration of the subscription option I purchased (monthly or bi-annually). NOTE: All costs and fees paid to the YSO are non-refundable once the YSO is activated. Yarnell does not grant refunds or pro-rated refunds for YSO subscription options for any reason.

METHODS OF PAYMENT

I understand that my access to YSO is based on the online subscription option purchased. Yarnell accepts Visa, MasterCard, and Discover for YSO recurring billing payments. No checks can be used for YSO Memberships. By clicking "Charge My Card and Enroll Me," I confirm that I have read and accept YSO Terms and Conditions. I also agree to let Yarnell Studio & School of Fine Art LLC update (e.g. upon expiration) and charge your payment method. I understand my YSO membership will auto-renew at the end of my subscription term. If I decide to cancel, I understand that it is my responsibility to do so before my renewal date to avoid being charged for the next period. Cancelations are initiated by me and Yarnell provides a confirmation code with cancelations.

STUDENT CODE OF INTEGRITY AND RESPONSIBILITY

The YSO is designed to further my ability as an artist. Achievement of this mission is dependent upon the development of autonomous thought and respect for the ideas of others. My account will be disabled and/or terminated without refund if I am caught in any form of dishonesty, including but not limited to, Plagiarism. Plagiarism is the intentional or unintentional representation of another’s work or ideas as one’s own in an YSO exercise or presenting work as the student’s own that has been prepared in whole or in part by someone other than that particular student. This includes the purchase and/or sharing of work.

ACCOUNT POLICY

Yarnell reserves the right to de-activate or remove any user accounts provided at YarnellSchool.com/YSO without notice if user has provided wrong information, has violated common Internet policies, has violated any of the terms and conditions contained in this document, or if the account has been inactive for more than two (2) years.

TRANSFER OF MEMBERSHIP

Students who register in the YSO may not transfer their registration to any other individual at any time.

COMPUTER LITERACY IS A PREREQUISITE OF YSO

Yarnell will not provide basic computer training; I am expected to be computer literate in order to participate in the YSO. This means that I understand basic computer operations, possess the ability to access the YSO site, and remember access (logins).

YSO MATERIALS

None of the YSO contents and instructional materials can be used or reproduced for any commercial purposes.

YSO ACCESS

I understand that although Yarnell aims to offer me the best service and experience possible, Yarnell makes no promise that the services available at the YSO will always meet my requirements or expectations. Yarnell cannot guarantee that the Service will be always fault-free. If a fault or issue occurs with the Service, I should report it to info@yarnellschool.com. Once reported, Yarnell will make the best effort in the most reasonable amount of time and manner to address and correct the reported issue and restore my access to the YSO. YSO may be occasionally restricted to allow for repairs, maintenance, or the introduction of new facilities or services. Yarnell will post notice for scheduled repair and maintenance of service. Yarnell will attempt to restore the Service as soon as Yarnell reasonably can.

ELECTRONIC COMMUNICATIONS

When I visit YarnellSchool.com and/or any of our other approved affiliated websites or send e-mail to Yarnell, I am communicating with Yarnell electronically. By registering at their website or purchasing from the shopping cart, I consent to receive communications from Yarnell electronically. Yarnell will communicate with me by e-mail or by posting notices on the YSO site. I agree that all agreements, notices, disclosures and other communications that Yarnell provides to me electronically satisfy any legal requirement that such communications be in writing.
